Minutes for the
May 19, 2011

        The Zoning Board of Appeals (ZBA) was called to order by Chairman Al Schutte at 7:30 PM on Thursday, May 19, 2011, in the Council Chambers of the Village of Evendale Municipal Building.  Attending were Chairman Al Schutte, members Dave Harwood, Tom Lippert, and Lynn McCarthy.  Member Mike Reed was absent.  Supporting the ZBA was Pam Morin, Building Department.

The following request was heard:

        Cincinnati Bell, 10000 Reading Road
        A request for a variance from the Village of Evendale Zoning Code Section 1266.12(a), prohibiting fences in the General Commercial District.

        Cincinnati Bell has contracted with Couch Fence to install a seven foot chain link fence with three strains of barbwire on top, reaching a total height of eight feet.  This fence will be placed around their four air conditioner units.  Cincinnati Bell has experienced some theft of their air conditioner units at other sites.  Cincinnati Bell feels that this type of fence is necessary to secure these units.  David Couch, Couch Fence, explained that the fence will be installed between the driveway and units so the driveway will always remain accessible.  The yellow parking bollards will be located outside the fence.   There will be four twelve foot wide gates, so each unit can be easily reached.

        Al Schutte stated that he is against barbwire in general and felt that granting the variance to install this type of fence would not only set a precedence of allowing fences in the General Commercial District, but also allowing barbwire.  There was a discussion if Cincinnati Bell would be willing to have the fence without the barbwire.  David Couch said that he thought they would.  Tom Lippert stated that since the fence is in the rear yard where no one should be entering, the fence and barbwire was a reasonable request.  Lynn McCarthy felt that the fence would make the entire area more esthetic.

        Adjoining property owners were notified of the variance request.  No responses were received.

        The six justifications were read and discussed.  During this discussion, Dave Harwood pointed out that this site is unique in the General Commercial District, in that the building is a relay station and does not have the typical traffic of commercial businesses.

        Dave Harwood made and Tom Lippert seconded a motion to grant the variance as submitted.  The motion passed with a vote of 3 yes, 1 no.

        The minutes were read.  Al Schutte made a motion to approve the minutes with the addition of noting who were present at the meeting.  Dave Harwood seconded the motion.  The motion was passed with a vote of 3 yes, 0 no, with Tom Lippert abstaining.

        The meeting was adjourned at 7:50 PM
